1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and TaxStats Ltd ("Company", "we", "our", or "us") governing your access to and use of the TaxStats Source platform, including any associated services, features, and content.
By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.
2. Description of Services
TaxStats Source provides digital tax management services including:
- AI-powered document scanning and categorisation
- Income and expense tracking
- Tax calculation and estimation
- Quarterly and annual submission to HMRC via Making Tax Digital APIs
- Bank feed integration
- Cloud storage connectivity
Our software is HMRC-recognised for Making Tax Digital for Income Tax Self Assessment (MTD ITSA) purposes.
3. Account Registration
To use our services, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
4. Subscription and Payments
Pricing
Our services are offered on a subscription basis. Current pricing is displayed on our website and may be subject to change with 30 days' notice.
Billing
Subscriptions are billed in advance on a monthly or annual basis. You authorise us to charge your payment method automatically for recurring fees.
Refunds
We offer a 14-day money-back guarantee for new subscriptions. After this period, fees are non-refundable except as required by law.
Cancellation
You may cancel your subscription at any time. Access continues until the end of your current billing period. You remain responsible for any HMRC submissions initiated before cancellation.
5. Your Responsibilities
You are responsible for:
- The accuracy and completeness of all data you input
- Verifying tax calculations before submission
- Meeting all HMRC deadlines and obligations
- Maintaining appropriate records as required by law
- Obtaining necessary authorisations for HMRC connections
- Complying with all applicable tax laws and regulations
Important: TaxStats Source is a software tool, not a tax advisory service. We do not provide tax, legal, or financial advice. For complex tax matters, consult a qualified accountant or tax professional.
6. HMRC Integration
Our platform connects to HMRC systems via their official APIs. By using our HMRC integration features, you:
- Authorise us to act as your software provider for MTD purposes
- Grant permission to submit data to HMRC on your behalf
- Acknowledge that submissions are legally binding
- Accept that HMRC's terms also apply to these transactions
7. Intellectual Property
All content, features, and functionality of TaxStats Source, including software, text, graphics, logos, and trademarks, are owned by TaxStats Ltd and protected by intellectual property laws.
You retain ownership of your data. By using our services, you grant us a limited licence to process your data solely for providing our services.
8. Prohibited Activities
You agree not to:
- Use the service for any unlawful purpose
- Submit false, fraudulent, or misleading information
- Attempt to gain unauthorised access to our systems
- Interfere with or disrupt the service
- Reverse engineer or copy our software
- Use automated systems to access the service without permission
- Resell or redistribute our services without authorisation
9. Limitation of Liability
To the maximum extent permitted by law:
- Our services are provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the fees paid in the 12 months preceding the claim
- We are not responsible for penalties, interest, or additional tax assessments from HMRC
Nothing in these Terms excludes liability for death, personal injury, fraud, or any liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold harmless TaxStats Ltd and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of third-party rights.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or through our platform at least 30 days before taking effect. Continued use after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
